Cure Gate LLC — Terms of Use

These Terms of Use govern access to the CureGate website and any Cure Gate LLC-controlled services made available through it (collectively, the Platform). By creating an account, submitting an organization access request, using a Platform feature, or indicating acceptance where requested, a user agrees to these Terms and the Privacy Notice. Cure Gate LLC, a California limited liability company (CA SOS No. B20260351772), operates in the United States. The Platform is intended to help organize information and support clinical-trial navigation and research-operation workflows. The Platform is not an emergency service, a substitute for a treating clinician, a diagnostic service, an eligibility determination service, an enrollment service, or a guarantee that a trial, site, sponsor, or clinical service is available or appropriate.

Platform content and automated tools are informational or administrative. Cure Gate LLC does not diagnose, prescribe, determine study eligibility, make treatment or enrollment decisions, or replace professional clinical judgment. Decisions about care, study participation, eligibility, enrollment, consent, or disclosure must be made by the appropriate person or organization under applicable law and, where applicable, qualified clinical review. The Platform is not designed for emergency communications. For urgent or emergency needs, users should call emergency services or seek urgent medical attention.

Features may be made available in stages and may depend on role, agreement, authorization, organization status, consent, security review, and technical controls. Cure Gate LLC may limit, suspend, decline, or defer a feature to protect privacy, security, compliance, patient safety, or Platform reliability. Current availability does not include automatic clinical eligibility, enrollment, treatment, or diagnosis decisions; automatic external referral or provider delivery; messages to research sites, sponsors, or CROs without clinician approval; public profile release; real-document transfer; or external sensitive-information release unless separately enabled under an approved controlled workflow. Patient text messages are sent only when the patient has opted in. Descriptions of future capabilities are not a current promise that those capabilities are live or available.

Users must provide accurate information, protect their credentials, and promptly report suspected unauthorized use to info@CureGate.ai. Users may not share credentials or use another person's account without authorization. An organization access request is a request for review only. Submitting a request does not create an organization, tenant, account, role, credential, site relationship, study relationship, or right to access the Platform. Cure Gate LLC may review, decline, defer, or request further verification before any access is provisioned.

Users may submit only information they are authorized to provide. Users must not submit information in violation of law, contract, professional obligation, or another person's rights. A person submitting information for another represents that the person has the authority and any consent required for that submission. Users must not submit unlawful, deceptive, malicious, infringing, or security-compromising content. Users must not attempt to bypass role controls, access controls, rate limits, consent controls, audit controls, or other safeguards.

The collection and use of personal information are described in the Privacy Notice. Where a workflow requires consent or authorization, Cure Gate LLC may require versioned evidence and may restrict processing, disclosure, or access when required evidence is missing or cannot be verified. Acceptance of these Terms does not authorize Cure Gate LLC to disclose health information to a research site, sponsor, CRO, provider, or another third party. Any such disclosure, if a controlled workflow is separately activated, remains subject to applicable law, relevant agreements, and any required separate consent or authorization.

Cure Gate LLC may use deterministic or AI-assisted tools for limited administrative, organizational, safety, integrity, routing, audit, duplicate, or precheck functions. Such tools may be limited to internal or synthetic validation environments and may be unavailable. They do not provide medical advice, diagnose a condition, determine clinical eligibility, make enrollment or treatment decisions, override required human review, or independently release sensitive information.

The Platform, its design, software, text, graphics, trademarks, and other content are owned by or licensed to Cure Gate LLC and protected by applicable law. Subject to these Terms, Cure Gate LLC grants a limited, revocable, non-transferable right to use the Platform for its intended purpose. Users may not copy, modify, reverse engineer, scrape, interfere with, or use the Platform to build a competing service except where a restriction is prohibited by law.

Cure Gate LLC may suspend, limit, or terminate access when reasonably necessary to protect users, the Platform, data, safety, security, legal compliance, or contractual obligations; to investigate suspected misuse; or when a user violates these Terms. Cure Gate LLC may act without prior notice when needed to address a security, privacy, safety, or legal risk. The Platform is provided on an "as available" basis, subject to applicable law. Cure Gate LLC does not guarantee uninterrupted or error-free operation, clinical-trial availability, a match, eligibility, enrollment, response time, outcome, funding, site capacity, or clinical benefit.

Program name: CureGate Patient Updates, operated by Cure Gate LLC. Description: Cure Gate LLC sends transactional text messages only for the purposes a patient opts in to. Patient registration offers three separate, optional checkboxes: (1) clinical trial match requests, (2) case updates, and (3) appointment and callback reminders. Each is a separate consent; we text only for the purposes checked. With separate opt-in we may also send a shareable summary the patient asked to forward to family or a treating physician, or an unfinished registration. These are not marketing or promotional messages. Message types: transactional only. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to applicable law, disputes relating to these Terms or the Platform will be brought in the state or federal courts located in California, and the parties consent to their jurisdiction. Cure Gate LLC may update these Terms by publishing an updated version and effective date and providing notice where required by law. Continued use after the effective date may constitute acceptance where permitted by law. Material changes affecting data use, consent, or users' rights will be handled as required by applicable law.
